The Spanish government has ordered the public prosecutor’s office to open an official investigation into the platforms ‘X’, ‘Meta’, and ‘TikTok’ following accusations related to the creation and distribution of AI-generated child sexual exploitation content.

It was explained via an official account that the Council of Ministers will activate Article 8 of the Statute of the Public Prosecutor’s Office to pursue these companies, confirming that these platforms have become a direct threat to the mental health, dignity, and rights of minors, and emphasizing that “the impunity of giants must end.”

This measure comes within the broader context of actions launched since the beginning of February to protect children in the digital space. Among the most prominent proposals is the move to completely ban minors under the age of sixteen from accessing social networks.

Despite the necessity of this step to protect the youth, technology experts point to complex logistical and legal challenges facing its implementation, especially concerning age verification mechanisms and digital privacy protection.

A Digital Social Contract in Europe
Spain is following in the footsteps of countries like France, which imposes restrictions on those under fifteen, and Australia, which raised the ban age to sixteen. The United Kingdom has also recently joined, announcing plans to accelerate legislation preventing teenagers under sixteen from accessing these platforms, with expectations for the law to come into effect after next summer.

While the concerned companies have remained silent so far, observers believe Europe is moving towards drafting a new digital social contract, placing child safety above commercial interests, which could lead to billion-dollar fines or radical changes in how these platforms operate.
